PR and Branding Service Terms and Conditions
Effective Date: April 2026By purchasing the PR and Branding service from NXTGEN BIZ and Co., you confirm that you have read, understood, and agreed to these Terms and Conditions in full. These terms are binding upon payment.
1. Service Description
The PR and Branding service is a fixed-scope 6-day engagement that includes brand narrative strategy, branded storyline crafting, brand voice guidelines, press release writing and editing, direct journalist and contributor pitching, newswire distribution coordination, three community amplification posts, and a media performance report.
This service is delivered by Carol Zurita through NXTGEN BIZ and Co. The service fee covers the strategy, writing, pitching, and coordination work only. Media placement fees, newswire distribution costs, and any third-party publication fees are separate and are agreed and paid directly by the client before pitching begins.
2. Payment Terms
The PR and Branding service fee is $1,500 USD, payable in full and upfront before work begins. No work will commence until payment is confirmed. By completing payment you agree to these terms in full.
Media fees, if applicable, are agreed separately on Day 1 of the engagement and are paid directly by the client to the relevant media outlets, newswire distributors, or publication networks. These fees are not collected by NXTGEN BIZ and Co.
3. No Guarantee of Media Placement
NXTGEN BIZ and Co. does not guarantee media placement, editorial pickup, or publication of any press release or pitch. We pitch professionally and strategically to journalists, contributors, and editors across agreed outlets. Editorial decisions rest entirely with the publications and are outside the control of NXTGEN BIZ and Co.
Factors outside our control that may affect media pickup include but are not limited to: editorial calendars, competing news cycles, journalist availability, publication policies on sponsored or organic content, and the perceived newsworthiness of the announcement at the time of pitching.
The client acknowledges that paying the service fee does not guarantee any specific media outcome. The service fee covers professional strategy, writing, and outreach work regardless of editorial decisions.
4. Refund Policy
All payments for the PR and Branding service are strictly non-refundable. Once work has commenced, no refunds will be issued under any circumstances, including but not limited to: failure to secure editorial coverage, rejection by targeted media outlets, dissatisfaction with press release content after approval, or changes in project direction after Day 1.
Media fees paid directly to third-party outlets, newswire distributors, or publication networks are also non-refundable once committed. The client is advised to confirm all media budgets and outlet selections carefully during the Day 1 strategy session before any fees are committed.
The service fee reflects the professional time, expertise, and industry relationships invested in crafting and pitching the announcement. These resources are consumed regardless of editorial outcomes.
5. Media Distribution Partners
NXTGEN BIZ and Co. works with a network of media distribution partners and newswire services to maximize the reach of press releases when direct editorial pitching does not result in organic placement. These partners charge distribution fees that are paid directly by the client.
Distribution through newswire services guarantees syndication to a network of outlets but does not guarantee editorial coverage or prominent placement. The client acknowledges this distinction before committing media budget.
NXTGEN BIZ and Co. will always present the media budget options transparently on Day 1 so the client can make an informed decision before any third-party fees are committed.
6. Client Responsibilities
The client agrees to:
- Provide accurate, truthful, and complete information about the announcement during the Day 1 strategy session
- Review and approve the brand guidelines on Day 3 and the press release on Day 4 within the agreed timeframe
- Not make false or misleading claims about their project, product, funding, or partnerships that would be included in the press release
- Confirm media budget commitments in writing before any third-party fees are engaged
- Provide access to social channels for the three community amplification posts or approve the content for self-publishing
NXTGEN BIZ and Co. reserves the right to terminate the engagement without refund if the client requests the inclusion of false, misleading, or legally problematic claims in any deliverable.
7. Client Approval and Responsibility
The press release will be submitted to the client for review and approval before distribution. Once the client approves the press release in writing, NXTGEN BIZ and Co. is not liable for any consequences arising from the content of the approved document, including but not limited to reputational damage, regulatory scrutiny, or legal claims from third parties.
The client is solely responsible for ensuring that all claims made in the press release are accurate, legally compliant, and do not infringe on the rights of any third party.
8. Confidentiality
NXTGEN BIZ and Co. will treat all project information shared during the engagement as confidential until the press release is published. After publication, the announcement is considered public information.
9. Intellectual Property
Upon full payment and delivery, the client receives full ownership of the press release, brand guidelines, and community amplification posts delivered as part of the engagement. NXTGEN BIZ and Co. retains the right to reference the engagement as a case study without disclosing confidential project details.
10. Limitation of Liability
The total liability of NXTGEN BIZ and Co. under this agreement shall not exceed the total service fee paid by the client for the PR and Branding engagement. NXTGEN BIZ and Co. is not liable for any indirect, consequential, or incidental damages arising from the service, including but not limited to lost revenue, reputational damage, or failure to secure investment as a result of media coverage or lack thereof.
11. Dispute Resolution
In the event of a dispute, both parties agree to attempt resolution through good-faith negotiation before pursuing any legal action. This agreement is governed by the laws of Singapore, where NXTGEN BIZ and Co. is registered.
12. Amendments
NXTGEN BIZ and Co. reserves the right to update these terms at any time. The terms in effect at the time of purchase apply to that engagement. Updated terms will be published on thenextgenbiz.com.
